Welcome to Clickezy.

These Terms & Conditions (“Terms”) govern your access to and use of the Clickezy website, mobile applications, and related digital services operated by Clickezy Technovations Private Limited, a company incorporated under the laws of India.

Clickezy provides a digital platform where photographers can create professional profiles, showcase portfolios, publish photography-related content, and present their services.

By registering for an account, accepting these Terms, or accessing our services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you must not create an account or use the services.

For the purposes of these Terms:

• “Clickezy,” “Company,” “we,” “us,” or “our” refers to Clickezy Technovations Private Limited.
• “Platform” means the Clickezy website, Android application, iOS application, and associated services.
• “User” means any individual accessing or using the Platform.
• “Photographer” means an individual or photography business registered to create a professional profile or showcase photography-related services.
• “Content” means photographs, videos, reels, text, descriptions, portfolios, pricing information, and other material uploaded or published through the Platform.
• “Portfolio” means a collection of photographs, videos, and professional information displayed through a photographer’s profile.
• “Services” means the digital features and functionality provided through Clickezy.
• “Third-Party Services” means services provided by independent organizations, including infrastructure, identity verification, communications, or other technical service providers.

To register as a photographer on Clickezy, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding agreement.
• Provide accurate registration information.
• Complete identity verification where required.
• Have the necessary rights to publish your photographs, videos, and professional information.
• Comply with applicable laws and these Terms.

Photography studios and businesses may register through an authorized representative who has the authority to act on their behalf.

Clickezy may refuse, suspend, or terminate registration where eligibility requirements are not satisfied, subject to applicable law.

Photographers may be required to provide information including:

• Full name
• Mobile phone number
• Email address
• Professional or studio name
• Photography categories
• Professional service location
• Profile photograph
• Identity verification information

Users must ensure that the information provided is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your login credentials and protecting access to your account.

You must notify Clickezy promptly if you suspect unauthorized access to your account.

You must not create accounts using another person’s identity without lawful authorization.

Clickezy may require photographers to complete identity verification to support platform safety and authenticity.

Verification may involve Aadhaar-related information, subject to applicable Indian laws and UIDAI requirements.

Where required by law, Clickezy will obtain appropriate consent and make lawful alternative verification methods available.

Clickezy may reject or request additional verification where submitted information is incomplete, inconsistent, or reasonably suspected to be fraudulent.

Completion of verification does not constitute a guarantee of a photographer’s professional qualifications, competence, reliability, or the quality of services offered.

Clickezy will process identity verification information in accordance with its Privacy Policy and applicable law.

Clickezy allows photographers to establish a professional digital presence.

Photographers are responsible for the accuracy of information published through their accounts.

Photographers must not make false claims about their experience, qualifications, equipment, studio facilities, awards, or previous work.

Clickezy may review, restrict, or remove misleading or prohibited content in accordance with these Terms.

Photographers may use available Platform features to display their services and packages.

Photographers are responsible for ensuring that published prices and service descriptions are accurate and not misleading.

Unless Clickezy expressly provides an integrated booking or payment service, displaying a photography package does not itself create a booking agreement or payment obligation through Clickezy.

Photographers remain responsible for their own professional services, representations, and any independently agreed commercial arrangements.

Clickezy does not guarantee that displaying a package will result in customer enquiries, bookings, or revenue.

Clickezy allows photographers to publish photography-related visual content through available Platform features.

Clickezy may process uploaded media for compression, transcoding, thumbnail generation, storage, streaming, and technical delivery.

Clickezy may restrict or remove content that violates these Terms, applicable law, or the rights of others.

Users acknowledge that media displayed publicly may be viewed, shared, or captured by third parties. Clickezy cannot guarantee that publicly viewed content will never be copied without authorization.

Users must use Clickezy lawfully and responsibly.

Clickezy may investigate suspected violations and take proportionate action, including content removal, account restrictions, suspension, or termination.

Where appropriate and legally required, users will be provided with applicable notice or review mechanisms.

Photographers are independent professionals or businesses and are not employees, agents, or representatives of Clickezy solely by registering on the Platform.

Clickezy does not supervise or control independent photography services merely because a photographer has a Platform profile.

Clickezy is developing an ecosystem intended to help photographers become discoverable and connect with potential customers.

Customer discovery, messaging, enquiries, bookings, and related commercial features may be introduced or expanded over time.

The availability of such features will depend on the version of the Platform and the services released.

Where future booking, payment, commission, or transaction services are introduced, Clickezy may publish additional terms governing those services.

Clickezy may provide free access, introductory benefits, subscription plans, or promotional offers to eligible photographers.

Any introductory offer, including a six-month free subscription where offered, will be subject to the eligibility criteria, duration, feature access, and conditions communicated when the offer is made.

Unless expressly disclosed and authorized through an applicable purchase process, a free promotional period will not automatically create a paid subscription obligation.

Any future paid subscriptions will be governed by pricing, billing, renewal, cancellation, and refund terms disclosed before purchase.

Where subscriptions are purchased through Apple App Store or Google Play billing, the applicable store terms and requirements may also apply.

Clickezy reserves the right to introduce or modify subscription offerings prospectively, subject to applicable law and commitments already made to users.

Clickezy uses external technology and infrastructure providers to support its services.

These include Microsoft Azure and Hostinger for relevant hosting and infrastructure operations.

Additional authorized service providers may be used for identity verification, communications, media processing, security, and other Platform functions.

Third-party services may be subject to their own terms and privacy policies.

Clickezy remains responsible for its obligations under applicable law and its agreements with users.

Personal information collected through Clickezy is processed in accordance with the Clickezy Privacy Policy and applicable Indian law.

The Privacy Policy is available through the Clickezy website and applications.

Clickezy may restrict, suspend, or terminate an account where reasonably necessary because of:

• Fraudulent registration.
• Identity impersonation.
• Repeated intellectual-property violations.
• Unlawful content.
• Serious security threats.
• Material violations of these Terms.
• Legal or regulatory requirements.

Where reasonably practicable and legally appropriate, Clickezy may provide notice and an opportunity to address the issue.

Users may request account deletion through the application.

Termination does not automatically eliminate obligations or liabilities that arose before termination.

Photographers may request permanent account deletion through the Clickezy Photographer App.

After verification, Clickezy will initiate deletion of the account and associated personal information, including relevant profiles, portfolios, reels, packages, and KYC data.

Certain records may be retained where required or permitted by applicable law, including applicable security, regulatory, tax, or dispute-related obligations.

Protected backup copies may remain temporarily until their scheduled expiration.

Users unable to access the application may contact support@clickezy.com to request account deletion.

Clickezy respects intellectual-property rights.

If you believe content on the Platform infringes your copyright or other lawful rights, you may submit a complaint to:

support@clickezy.com

Clickezy may investigate complaints, request additional information, restrict disputed content, or take other appropriate action in accordance with applicable law.

Knowingly false or misleading complaints may result in appropriate action.

Clickezy aims to provide a reliable digital service but does not guarantee uninterrupted availability.

Clickezy may modify, improve, introduce, or discontinue Platform features.

Where a material change adversely affects existing user rights or paid commitments, Clickezy will provide notice or remedies as required by applicable law.

To the extent permitted by applicable law, Clickezy provides its Platform on an “as available” basis.

Clickezy does not warrant that the Platform will always be uninterrupted, error-free, or suitable for every particular professional or commercial purpose.

Clickezy does not independently guarantee the professional competence, authenticity of every representation, service quality, or commercial success of photographers registered on the Platform.

Nothing in these Terms excludes warranties, guarantees, or statutory rights that cannot lawfully be excluded.

To the extent permitted by applicable law, Clickezy will not be liable for indirect or consequential losses arising solely from matters outside its reasonable control, including independent business arrangements between photographers and third parties.

Clickezy remains responsible for liabilities that cannot lawfully be excluded or limited.

Nothing in these Terms excludes liability for fraud, wilful misconduct, or other liability that applicable law prohibits the Company from excluding.

Any limitation will be interpreted subject to applicable consumer-protection and other mandatory legal requirements.

To the extent permitted by applicable law, users agree to indemnify Clickezy against reasonable third-party claims, losses, or expenses arising directly from:

• Content uploaded without necessary rights or permissions.
• Fraudulent or unlawful use of the Platform.
• Material violations of these Terms.
• Infringement of third-party intellectual-property rights.

This obligation does not apply to the extent a claim results from Clickezy’s own unlawful conduct, negligence, or breach of its obligations.

Clickezy will handle complaints in accordance with applicable law and the grievance-redressal procedures relevant to the Platform.

Where required, the Company will publish the name, designation, and contact information of its designated grievance officer.

Nothing in these Terms restricts users from approaching competent statutory authorities or exercising remedies available under applicable law.

Clickezy may update these Terms to reflect:

• New Platform features.
• Changes in service offerings.
• Legal or regulatory requirements.
• Security improvements.
• Changes in business operations.

Updated Terms will be published on the Clickezy website with a revised effective or last-updated date.

Where required by law, Clickezy will provide appropriate notice or obtain renewed acceptance.

Continued use after a validly notified change may constitute acceptance to the extent permitted by applicable law.

These Terms are governed by the laws of India.

Subject to applicable mandatory legal provisions, disputes arising from these Terms may be brought before courts of competent jurisdiction in Bhubaneswar, Odisha, India.

This provision does not restrict statutory consumer remedies or other rights to approach competent courts, tribunals, or regulatory authorities where applicable law provides otherwise.

If any provision of these Terms is found invalid or unenforceable by a competent authority, the remaining provisions will continue to apply to the extent legally permissible.

These Terms, together with the Privacy Policy and any additional terms expressly applicable to particular services, constitute the agreement governing use of the Clickezy Platform.

Where additional terms apply to a specific service, those terms will govern that service to the extent of any expressly stated inconsistency, subject to applicable law.
